Limitations of Liability


Suburban Basement strives to deliver exceptional service, but unforeseen circumstances can arise. This statement outlines limitations of our liability.


Please note that some services have specific terms and conditions, which we strongly encourage you to review carefully (concrete leveling, Excavation and Exterior Waterproofing, and Interior Drain Tile,  Egress window well drain and sump pump installs).


This Liability statement does not supersede any specific terms and conditions outlined for individual services offered by Suburban Basement.


Suburban Basement is not liable for elements beyond our control, including, but not limited to:


  • Normal wear and tear
  • Unforeseen conditions (e.g., hidden structural issues, unknown utilities)
  • Acts of God (e.g., floods, earthquakes)
  • Alterations to our work performed by anyone other than a Suburban Basement Technician voids Suburban Basement’s liability.
  • Damage caused by environmental factors accumulating over time (e.g., iron deposits, root intrusion).


Scope of Services



Our services are offered with the understanding that Suburban Basement is a contractor, not a manufacturer or designer. We utilize industry-standard materials and practices to complete the agreed-upon services.

Warranty Coverage 


Warranty Claims

Submit claims to Suburban Basement. Call 586-465-5500 or email [email protected].

A copy of your invoice/receipt will be required as proof of service.

Important Notes Regarding Warranty Claims:

  • An Administration fee may be applied if multiple invoice/receipt copies are requested.
  • Warranty claims regarding sump pumps should be submitted directly to the manufacturer.
  • Homeowners are encouraged to retain a copy of their invoice/receipt.
An administrative fee will be charged for warranty claims involving:

  • Repairs performed by a different company
  • Repairs altered after our service
  • New issues not caused by our repairs
  • Claims due to lack of maintenance or external factors
Dispute Resolution

Suburban Basement is committed to resolving any concerns you might have regarding our services.  We encourage you to contact us directly to discuss any issues.  In the unlikely event of a dispute, you agree to attempt to resolve the dispute through mediation before resorting to litigation.

By using the services of Suburban Basement, you acknowledge that you have read, understood, and agree to the terms and conditions outlined in this General Liability Statement.

Concrete Leveling Terms

Customer Responsibilities:

Grading and Backfill: Maintain proper soil grading and backfill around the foundation and the concrete slabs after the project is complete.
Gutters and Drainage: Ensure functional gutters direct water away from the foundation and edges of concrete slabs when possible.
Cracks and Sealants: Seal expansion joints to prevent water infiltration which can cause erosion and slab settling.
Access and Utilities: Provide clear access to the work area and mark private utilities (example: low voltage lighting, sprinkler lines, etc.) beforehand. 
Presence: Homeowner or designee presence is required (unless prior arrangements approved) prior to commencing work and after work completion (see service fees).


Estimate: Subject to change due to unforeseen issues during the leveling process, such as voids found during the leveling process, adjustments communicated before continuation.
Service Fees: May apply for cancellations with less than 24 hours notice or homeowner (or designee) absence necessitating return visits.
Payment: Deposit may be requested upfront; remaining balance due at time of service.

Guarantee Terms:

Re-pump: Leveled areas settled over ¼” within 3 years may receive re-leveling.
Guarantee Requirement: slab cracks, saw cuts, and expansion joints must be sealed. Backfilling and proper gutter drainage are also required
Exclusions: Patches between slabs and cracks repaired by Suburban Basement or Customer.

Liability Waiver and Insurance:

Suburban Basement maintains insurance; homeowner accepts responsibility for damages.
Risks include concrete stains, existing cracks made visible during process,landscape damage, and imperfect slab alignment.
Liability for utilities is limited to those that are properly installed and marked, as well as those marked by the professional utility locating service MISS DIG. The service recipient is required to identify and mark any utilities not addressed by MISS DIG.
Maximum liability capped at $500 or job payment amount.

Governing Law, Venue, and Agreement:

Agreement governed by Michigan state laws; disputes resolved in local courts.
Customer agreement upon signing Suburban Basement estimate.
